“Client” refers to any individual or entity that requests and uses our services.
“Service” refers to the process serving and skip tracing services provided by Perth Process Servers WA.
“Document” refers to any legal or official document to be served or used in our services.
3. Services Provided
We offer professional process serving and skip tracing services. Our services include but are not limited to the delivery of legal documents and locating individuals for legal purposes.
4. Client Responsibilities
Provide accurate and complete information required for the service.
Ensure that any documents provided for service are legal and valid.
Acknowledge that the outcome of service or skip tracing is not guaranteed.
5. Service Execution
We will perform services in compliance with applicable laws and regulations.
We reserve the right to refuse service for any request that we deem illegal, unethical, or unreasonable.
6. Fees and Payment
Our fees will be communicated to the Client upfront.
Payment:
a) 100% pre-paid before commencement of service for individual, non-commercial clients.
b) as per Service Agreement for multi-service, commercial clients.
Non-payment of fees may result in suspension or termination of services.
7. Variation to Service
Where there is a change to the service, we will consult with the Client regarding additional fees.
8. Refunds
A change of mind or circumstance does not constitute a refund. A pro-rata refund may be issued at our discretion.
9. Confidentiality
We are committed to maintaining the confidentiality of our clients and their cases. Information will only be used for the purpose of providing the requested services.
10. Limitation of Liability
Perth Process Servers WA shall not be liable for any indirect, incidental, or consequential damages resulting from our services.
Our liability in any circumstance is limited to the amount of fees paid by the client.
11. Indemnification
The Client agrees to indemnify and hold harmless Perth Process Servers WA from any claims, damages, or expenses arising from the Client’s use of our services.
12. Jurisdiction
These terms and conditions shall be governed by and construed in accordance with the laws of Western Australia.
13. Amendments
We reserve the right to modify these terms and conditions at any time. Continued use of our services after any such changes shall constitute your consent to such changes.
